These Terms of Service for Users (“Terms”) are is legal agreement between the visitor (“You”) and Mindful Art Matter (“Studio”). It is important that you have read and understood all the terms and conditions stated herein before proceeding with a booking.
Booking Terms
You agree to all booking terms set forth by the Studio and to abide by the rules at all times, and that any breach of Studio rules might, in the Studio discretion, decide to bar or remove you from the property.
Bookings are available to all individuals who have attained a minimum age of eighteen (18) years. Bookings done by a parent for kids workshop agree that their child is between the age of 7 and below 12, for family workshop minimum child age is 6.
You should complete payment upon checking out online to confirm Your place in the workshop. You should receive an acknowledgement from the payment platform immediately. This will serve as confirmation of the reservation. If in doubt, kindly email us at info@mindfulartmatter.com.
The Studio reviews the booking fees periodically and changes them from time to time. In the event there is any proposed change in the booking fees, bookings made and dutifully paid will not be changed.
Cancellations & Rescheduling
You understand that the Studio reserve the right to cancel, delay, postpone or amend the whole or any part of your reservation at any time for any reason without prior notice and that the Studio may, in their sole discretion, refuse any visitor from visiting the Studio.
You agree and acknowledge that any workshop purchased is non-refundable. Any changes and cancellations to your reservation must be made at least 48 hours before the Studio booking or You will be charged the full fee of booking.
Bookings that were made and deemed as “No-Show” will be forfeited and non-refundable.
Conduct of Workshops
Workshops start on time and if You arrive more than 10 minutes late, the Studio can refuse You entry and attendance as this is disruptive to the workshop instructor and other visitors. We suggest that you arrive 10 minutes in advance of your booking time to allow optimal time to prepare for the workshop.
You agree to follow all instructions and safety precautions from the Studio to prevent any injury to themselves and other participants, as well as damage to the Studio.
During workshops, photographs and videos will be taken and shared with You as memories of the experience. The Studio has the right to use these photographs and videos for training and marketing purposes. You may inform the Studio prior to the workshops should You have any concern.
You are advised to collect artworks within 2 weeks’ of the workshop. Extended storage beyond 30 days of the workshop will be chargeable at a minimum of $50 per artwork per month. The Studio reserves all rights to dispose of unclaimed artworks without notice.
Kids Workshops
You individually and behalf of your child, understand, agree, and acknowledge the assumption of risk, liability release, and indemnity as stated in sections below. You understand the risks of leaving your child for workshops at Mindful Art Matter.
Kids workshop will end promptly on time. You are advised to arrive at 5 minutes prior to the end of the workshop to pick up your child. We will contact the parent/legal guardian if any child is not picked up 10 minutes after the workshop.
Assumption of Risk
You understand that there may be risks involved in work done at the Studio and assume all of the foregoing risks, and the risk of injury caused by the condition of any property, facilities or equipment used at the Studio, and to the maximum extent permitted by applicable law, accept personal responsibility for any injury, illness, damage, loss, claim, liability or expense, or any kind or nature, that You or the property may suffer before, during and/or after my participation in the Studio, whether arising in whole or part, directly or indirectly, out of or in connection with the Studio or your visit therein.
You agree and acknowledge that you are responsible for your own health and safety and that You will be visiting the Studio at my own risk. You further hereby represent, warrant and undertake to the Studio the following with full knowledge that You are mentally and physically fit and competent, and have no medical condition that would affect my mental and physical well-being arising from my visit at the Studio.
Liability Release & Indemnity
To the maximum extent permitted by the law of Singapore, You release and forever discharge and agree to save and hold harmless the owners, lessors and lessees of property, facilities, and equipment, used in connection with the Studio and their respective directors, officers, employees and agents (each such entity or individual being referred to as a “Released Party”) of and from any and all injuries, illness, losses, damage, claims, liabilities or expenses, of any kind or nature (and whether accruing to You, Your heirs or Your personal representatives) that are caused or alleged to be caused in whole or in part by the action, negligence or failure to act of any Released Party and that arise out of or in connection to Your visit to the Studio.
In addition, You agree to indemnify and hold harmless the Released Party from and against any claim, loss, liability or cost of any person, firm or corporation, including, without limitation, reasonable legal fees, arising out of any breach of any warranty, representation or undertaking made by You in this Release. In the event of any claim or service of process upon any Released Party involving the indemnification set forth, Mindful Art Matter or such other Released Party shall notify You of the claim and undertakes to make all reasonable endeavours to assist Your in adjusting, settling, defending or otherwise disposing of such claim at your sole cost.
Personal Data
By booking a session with Mindful Art Matter, You hereby agree that the Studio may collect, use internally and disclose my personal data that You provide in the relevant Forms and during registration for the purpose of administration in accordance with the Personal Data Protection Act (PDPA).
Legal Action & Updates
The Studio reserves all rights to pursue legal action for any damage to the Studio or injury to the instructor.
Mindful Art Matter reserves all rights to make changes or update these terms and conditions whenever necessary. In case of any dispute, we reserve all rights to make the final decision.
